SEC Announces the Release of its Fall Regulatory Agenda

On December 6, the Securities and Exchange Commission (SEC) announced the release of its 2023 Fall Regulatory Agenda which includes estimated timeframes for specific rulemaking topics. In the release, the SEC estimates final rules for the Open-End Fund Liquidity Risk Management and Swing Pricing, Cybersecurity Risk Management for RIAs and RICs, and Enhanced Disclosures on ESG Investment Practices proposals around April 2024. This timeline was bumped out from the Spring agenda, which previously expected final rules in October 2023. Additionally, the Division of Investment Management’s potential proposal on Fund Fee Disclosure was pushed out from April 2024 to October 2024. SEC Chair Gary Gensler noted the Commission is “updating our rules to promote the efficiency, integrity, and resiliency of the markets… with an eye toward investors and issuers alike, to ensure the markets work for them and not the other way around.”
